Welcome to MyFiesta. These Terms and Conditions ("Terms") govern your use of our RSVP management service. By accessing or using MyFiesta, you agree to be bound by these Terms.

By using our service, you confirm that you accept these Terms and that you agree to comply with them. If you do not agree to these Terms, you must not use our service.

Description of Service

MyFiesta is a web-based service that allows users to create, customize, and manage RSVP forms for events. Our service includes features such as:

• Creating customizable RSVP forms
• Managing guest responses
• Generating QR codes for easy event access
• Exporting guest data
• Payment processing for premium features

User Accounts

Account Creation

To use certain features of our service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

Acceptable Use

You agree to use our service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the service for any illegal or unauthorized purpose
• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Upload or transmit malicious code or content
• Attempt to gain unauthorized access to our systems
• Use the service to spam or harass others
• Create false or misleading events

Content and Data

Your Content

You retain ownership of any content you submit to our service. By submitting content, you grant us a limited license to use, store, and display your content as necessary to provide our service.

Prohibited Content

MyFiesta is intended for all ages. You may not submit content that is or includes:

• Illegal, harmful, or offensive material
• Infringing on intellectual property rights
• Containing personal information of others without consent
• Spam or promotional content unrelated to your event

18+ and Adult Content Restrictions

We strictly prohibit any content intended for adult audiences only. This includes, but is not limited to:

• Sexually explicit material or imagery
• Graphic violence or gore
• Content depicting or promoting illegal drug use
• Explicit language or profanity in event listings
• Any content that would be considered inappropriate for minors

Proscribed Entities and Political Content

The following restrictions apply to events and content on our platform:

• Events or content promoting, supporting, or affiliated with proscribed organisations or terrorist entities are strictly prohibited
• Events that raise funds for or recruit on behalf of proscribed entities are not permitted
• Promotional content for political parties is not allowed
• However, events organised to support political parties (such as fundraisers, rallies, or meetings) are permitted, provided they comply with all other terms

Content Enforcement

We reserve the right to remove any event listing without prior notice and without refund if we determine, at our sole discretion, that the content violates these Terms. This includes but is not limited to:

• Immediate removal of events containing prohibited content
• Suspension or termination of accounts associated with violations
• No refunds will be provided for events removed due to Terms violations
• We are not obligated to provide explanation or warning before taking action

Data Retention and Event Lifecycle

By using our service, you acknowledge and agree to our data retention policies:

Event Expiration

• Basic events expire after 1 year from creation
• Premium events expire after 2 years from creation
• You will receive automated notifications 30, 14, and 1 day before expiration
• Expired events become inaccessible to guests but data remains available to you

Data Retention Period

• After event expiration, you have 30 days to access and download your data
• We will send reminder notifications when you have 14, 7, and 1 day remaining
• All data including RSVP responses and event details can be downloaded from your dashboard
• After 30 days, data is automatically archived and removed from active systems

Data Archival and Final Deletion

• Archived data is securely stored for 6 months for technical and dispute resolution purposes
• During archival, data is encrypted and access is restricted to authorized personnel
• After 6 months, all archived data is permanently and irreversibly deleted
• You may request access to archived data by contacting our support team

Your Responsibilities

You are responsible for:

• Monitoring expiration dates of your events
• Downloading any data you wish to retain before the 30-day deadline
• Understanding that data deletion after the retention period is irreversible
• Complying with applicable data protection laws regarding guest information

Payment Terms

Fees

Certain features of our service require payment. All fees are clearly disclosed before purchase and are non-refundable except as required by law.

Payment Processing

Payments are processed through third-party payment processors. You agree to their terms of service and privacy policies.

Intellectual Property

The MyFiesta service, including its design, functionality, and content, is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our service without permission.

Privacy

Automated Notifications

Our service includes an automated notification system that helps manage your event lifecycle:

• Email notifications are automatically sent to your registered email address
• Notifications include expiry warnings and data retention reminders
• All notification emails include direct links to your event dashboard for easy access
• You are responsible for maintaining a valid email address to receive these important notifications
• Failure to receive notifications due to invalid email addresses does not extend data retention periods

Service Availability

We strive to maintain high availability of our service, but we do not guarantee uninterrupted access. We may temporarily suspend the service for maintenance, updates, or other operational reasons.

Termination

We may terminate or suspend your account and remove event listings at any time, without prior notice, for violation of these Terms or for any other reason at our sole discretion. No refunds will be provided for accounts or events terminated due to Terms violations.

You may terminate your account at any time by contacting us or using the account deletion feature.

Disclaimers

Our service is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of our service or violation of these Terms.

Governing Law

These Terms are governed by the laws of California, United States, without regard to conflict of law principles.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date.
